DAC IP INSIGHT

Every invention begins with an idea.

Sometimes it is a new machine. Sometimes it is a manufacturing process. Sometimes it is a solution to an everyday problem that no one else has managed to solve.

For many inventors, the first instinct after developing a new idea is to tell others about it. They may discuss it with friends, present it at conferences, post it on social media, or demonstrate it to potential investors and business partners.

Yet this excitement can create a serious legal problem.

One of the most important principles of patent law is that an invention must be new.

In many jurisdictions around the world, publicly disclosing an invention before filing a patent application can destroy the novelty of the invention and make it impossible to obtain patent protection.

This creates what may be called The Inventor’s Dilemma.

On one hand, inventors often need to discuss their ideas with investors, engineers, manufacturers, customers and collaborators in order to develop and commercialise their innovations.

On the other hand, disclosing too much information too soon may jeopardise the very intellectual property rights that could give the invention its value.

The challenge is therefore finding the right balance between promoting an invention and protecting it.

This is why intellectual property professionals frequently advise inventors to seek legal guidance before publicly revealing significant details of a potentially patentable invention.

In some cases, confidentiality agreements and carefully planned patent strategies can help preserve valuable rights while allowing commercial discussions to proceed.

History has shown that many of the world’s most successful businesses were built upon innovations protected by patents.

A patent can provide an inventor with exclusive rights, attract investment, create licensing opportunities and establish a competitive advantage in the marketplace.

The lesson for innovators is simple: not every idea should be kept secret forever, but some ideas should be protected before they are shared.

Sometimes the greatest mistake an inventor can make is speaking too soon.
